Social Ethics

Is it the real standard? (Explained)

Man fears anything associated with death. The quest for survival and self-preservation is one of the innate characteristics of man. Since death is considered the end of the physical survival of every mortal being, man will search and will continue searching for solutions in order to preserve life. Peace and order are incidental in the course of the “social contract” entered into by the community of prudent individuals. It's just like this, our primary goal is to survive; peace and order are subsidiaries.


The first time I heard about “social contract” was with Thomas Hobbes. It was through this “social contract” that an artificial man is created. It exercises natural strength and defense power to maintain the survival of the higher species in the intellectual kingdom (humans). Peace and Order are implied in the duties and powers of the Leviathan in carrying out its expressed purpose and nature. Man, in this case, created an artificial man to advance his goal.

This is the very reason why laws are created, and regulations are approved and implemented -the hard laws. However as creative and imaginative being, man had also formulated norms, beliefs, and actions (soft laws) to further strengthen his capacity to survive (a normal reaction for an insecure person). And since the time of its (soft law) conception, people has religiously followed those ideas without getting back to the reasons why they keep on practicing these things. All they know is, this is the good (holy) way to live life.

The cycle continues, modern man is hypnotized by, and is practicing vanity with, ethics. The soft laws had been inked and converted into hard laws; others remain as they are, but seems like the same either. So many rules to follow already, and it's getting complicated. We cannot follow three (or more) fabricated rules at the same time.

There is a saying, you cannot solve a problem by creating another one. This too follows the premise; We cannot get away from chaos by creating chaotic rules. There are no excuses, there are no accidents, everything happens for a reason. We must find that reason. Balance of nature will tell you that to balance the problem there is a solution :-) . Believe!

This writer agrees that laws should be flexible with times and the manner of the situations that are rising. However, he argues that such principle will apply most to trade, commerce, industries and governmental relations, state-citizens interactions and technical regulation of citizen-citizen dealings (civic relations) which are generally hard laws.

How about with those so-called soft law? Make it simple with this principle, “Don't touch me, I won't touch you.”

*Leviathan is what we call the “state” or the “government” at present.
Man has two types, natural and artificial.
Natural - those who were born physically from the mother's womb
Artificial – those are created by laws or articles of incorporation such as the state and its political subdivisions, government owned and controlled corporations and private entities and corporations.
